What Are the Steps to Petition for a Spouse or Child?
April 30, 2026

The U.S. immigration system can feel overwhelming, especially when the outcome determines whether you can build a life together with your loved ones. At Zaveri Law Firm P.C., we deeply understand that family reunification is the heart of U.S. immigration law. Bringing your spouse or child to the United States is a profound milestone. To help ease your anxiety and provide a clear path forward, we have broken down the family-based immigration process into manageable steps for both U.S. citizens and Lawful Permanent Residents (LPRs).

The Petition Process (Form I-130)

The journey to unite your family begins with the petitioner, the U.S. citizen or LPR, filing Form I-130, Petition for Alien Relative, with U.S. Citizenship and Immigration Services (USCIS). This form serves a single purpose: establishing the qualifying family relationship between you and your beneficiary.

To ensure a smooth initial review, you must provide compelling evidence of your bond. Required documentation typically includes:

  • Proof of your status: Your U.S. passport, birth certificate, or green card.
  • Proof of relationship: Marriage certificates for spouses or birth certificates for children naming the petitioner as a parent.
  • Evidence of a bona fide marriage (for spouses): Joint bank account statements, property leases in both names, shared utility bills, and photographs together to prove the relationship is genuine.

Wait Times and Priority Dates

Once USCIS approves the I-130 petition, the next steps depend entirely on the immigration category your relative falls into. The system divides family members into two distinct groups, which dictate how long you will wait for an available visa.

  • Immediate Relatives: This category includes the spouses and unmarried children (under 21) of U.S. citizens. The U.S. government does not cap the number of visas available for immediate relatives. Therefore, there is no waiting line for a visa number once the petition is approved.
  • Family Preference Categories: This group includes the spouses and minor children of Lawful Permanent Residents, as well as the adult or married children of U.S. citizens. Because these visas are capped annually, beneficiaries receive a “priority date” (the date your petition was filed). You must wait until this date becomes current on the Visa Bulletin before moving forward.

The Next Steps: Consular Processing vs. Adjustment of Status

When a visa number becomes available, the application process splits into two distinct paths depending on where your spouse or child currently lives.

  • Adjustment of Status: If your relative is already inside the United States through a lawful entry, they can typically apply to adjust their status to a permanent resident without leaving the country. This involves filing Form I-485 directly with USCIS.
  • Consular Processing: If your family member resides outside the United States, their approved case transfers to the National Visa Center (NVC). After submitting additional financial and civil documents to the NVC, the beneficiary will complete processing at the local U.S. Embassy or Consulate in their home country.

Final Steps to Your Visa or Green Card

The final stages of the process focus on health and security clearances. Your spouse or child must undergo a thorough medical examination conducted by a government-approved physician.

Following the exam, the beneficiary will attend an in-person interview with an immigration officer. This interview verifies the information in the application and confirms their eligibility. Once approved, they will receive their immigrant visa to travel to the U.S., or, if adjusting status, their physical green card in the mail.
