Green Card Application Process

We have provided a list of the standard steps in applying for a Permanent Resident Card, or green card, to help you understand what to expect. - Determine Eligibility: Your circumstances and reasons for entering the U.S. will determine which of the five basic green card eligibility categories you fall into. The categories include seeking asylum due to persecution, sponsorship from an employer or family member, and several other scenarios. - Determine the Appropriate Application Process: Those already in the U.S. when applying for a green card will use a process known as adjustment of status. Applicants living outside of the U.S. will go through consular processing. This means that their application will be processed by a United States Department of State consulate.
- Gather the Necessary Documents: You must provide documentation to the U.S. government to demonstrate your green card eligibility. While many of these documents can be submitted electronically, a few cannot. Your immigration attorney will determine which documents are required and help you properly submit them.
- File an Immigrant Petition: Green card applicants will need to file an immigrant petition. This petition is typically filed by an employer or family member when the applicant lives outside of the United States. After it is processed, you will be issued a visa number. If you are an immediate relative of a U.S. citizen, a visa number will not be needed.
- Apply for Green Card: Typically, the next step is to register for permanent resident status or adjustment of status. This is done by filing Form I-485. Your attorney will help you determine if a different form is needed.
- Biometrics Interview: If a biometrics interview is needed, you will be notified via email. This process involves collecting photos, fingerprints, and other information at an Application Support Center. This information is needed to confirm your identity and complete security checks.
- Green Card Interview: Following your biometrics interview, USCIS officials will determine if an in-person interview is needed. At this interview, your original documents will be presented and submitted along with your Form I-485 application.
- Approval!: A written decision will then be issued. If approved, you should receive your green card soon after. If your application has been denied, you will be given the reason and told whether or not you are eligible to apply for an appeal.
