Understanding the Green Card Process

A green card, officially called a Permanent Resident Card, allows you to live and work permanently in the United States. However, before you can apply, you must answer two essential questions. Are you eligible, and are you currently inside or outside the United States? The answers to these questions dramatically impact everything that follows.

Eligibility Categories

U.S. Citizenship and Immigration Services (USCIS) recognizes several main paths to a green card, including:

  • Family sponsorship for spouses, children, parents, and siblings of U.S. citizens or lawful permanent residents.
  • Employment for skilled workers, professionals, individuals with extraordinary ability, and certain investors.
  • Special immigrant status covers religious workers, certain juveniles, and other designated groups.
  • Refugee or asylee status for individuals granted humanitarian protection at least one year prior.
  • Human trafficking or crime victim status for individuals holding a T or U nonimmigrant visa.
  • The Diversity Immigrant Visa Program for individuals selected through the Department of State’s annual lottery.

Each category carries its own eligibility rules, required forms, and evidence standards. Choosing the wrong one or missing a requirement in the right one can cost you valuable time.

The General Application Process

While every case is different, most green card applications follow a similar sequence:

  1. Determine eligibility. Identify which category fits your circumstances.
  2. File a petition. In most cases, someone must file an immigrant petition on your behalf. This is often a family member or employer. Common forms include Form I-130 for family relationships and Form I-140 for employment-based cases.
  3. Choose your application process. If you’re inside the United States, you may pursue adjustment of status by filing Form I-485. If you’re outside the country, you’ll go through consular processing with the U.S. Department of State.
  4. Gather documentation. This typically includes birth certificates, marriage certificates, passports, financial records, and medical examination results.
  5. Attend a biometrics appointment. You’ll provide fingerprints, a photo, and a signature for identity verification and security checks.
  6. Complete an interview. A USCIS officer (or consular officer abroad) will review your case and confirm your eligibility.
  7. Receive a decision. If approved, you’ll receive your green card. If denied, you may have options to appeal or refile, depending on the reason.

Life After Approval

Green cards are generally valid for ten years and must be renewed by filing Form I-90 before expiration. Permanent residency comes with responsibilities, including filing tax returns and obeying U.S. laws. For certain individuals, these responsibilities also include registering with the Selective Service.

Extended time outside the United States can also raise questions about whether you intend to continue living here, so it’s worth understanding the guidelines around travel before you book that flight home. Eventually, once you meet the requirements, a green card can serve as your foundation for U.S. citizenship.
